Abstract
Examines mediation in Taiwan in light of a 2007 Scottish civil justice review recommending the use of mediation as part of the Scottish civil litigation system and citing Taiwan as a jurisdiction where mediation has successfully reduced the courts' workloads. Outlines the basic principles and rules of mediation. Analyses its various forms in Taiwan, focusing on court-annexed mediation. Evaluates the success of mediation in achieving settlement. Considers whether the system could successfully be adopted in Scotland. Presents the answers to the author's survey of 100 Taiwanese lawyers on their experience of mediation.
