Abstract
In this, the first part of a two part article, theories of arbitration adopted by national courts in relation to international commercial arbitration are discussed. Considers the scope of the jurisdictional and contractual theories including the relationship between arbitration and the national courts, the nature of the arbitrator's power, the status of arbitral awards and the choice of proper law.
