Abstract
This topic was last discussed in July 1990.' The Rules of Procedure of the Court of First Instance of the European Communities were finally adopted on 2 May 1991} These Rules establish that one of the members of the Court, other than the President, will be called upon to perform the role of an Advocate General when the Court sits in plenary session. If a chamber of the Court wishes an Advocate General to be appointed to a particular case it must request a plenary session of the Court to appoint one and the Court may do so only where "the legal difficulty or the factual complexity of the case so requires". It is the President of the Court who designates the member of the Court who will act as an Advocate General in a particular case.
